Biwak or DeepIP: which task should the tool solve?

Two tools for different tasks

DeepIP's product pages describe modules for drafting applications, for prosecution, for searching, and for freedom-to-operate and patentability analyses. These are the provider's statements on its feature set, not independent proof that the results are professionally correct.

What DeepIP does better

For the actual patent work, DeepIP brings specialist workflows that a general agent does not have:

  • From invention disclosure to application: the provider describes complete draft applications tailored to the relevant jurisdiction.
  • Office actions: rejections are analysed and structured responses with case-law references are drafted, directly in Word with comments and track changes.
  • Search and analyses: patent search, freedom-to-operate and patentability are separate modules; Biwak has no patent database and works with your files.

Consider DeepIP for drafting and defending patents, and Biwak for the office work around them. With both, unpublished inventions should only enter the workflow after a review under professional rules; what § 39c PAO (German Patent Attorneys' Code) requires for this is explained in the article AI in the law firm.

Test case: a draft application from a published invention

For the test, take an invention that has already been published, so that the material contains no secrets. Have DeepIP produce a draft application from it and draft the response to a closed office action. From Biwak, ask only for what a general agent can deliver: a table of the features with references from your documents, or a deadline list from a case file. A patent attorney evaluates both results and notes the correction effort; only then is a test with real client material worthwhile.

Frequently asked questions

May an unpublished invention go into an AI tool?

Only after a review. § 39c PAO requires a contract in text form with a confidentiality obligation for service providers and, for services abroad, comparable protection of secrets. The Federal Association of German Patent Attorneys points out that publication destroys novelty and anonymisation does not help, because the technical core is the secret. The DPMA (German Patent and Trade Mark Office) itself currently only uses internal AI applications for unpublished applications (FAQ on Communication No. 1/26).

Does Biwak replace specialised patent software?

No. Biwak promises neither a patent database nor an expert patent review. For draft applications and office actions, a specialist tool is the right category; Biwak helps with the office tasks alongside.

What should you look out for in a pilot for patent work?

Approved or published material, acceptance by a qualified person, and the correction effort per result. Check whether source references are correct and the draft is technically complete. A general file test is not enough for this question.
